Terms of Business for Service Users

These Terms of Business are the principal provisions governing the services provided by individual Care/Support Workers appointed by Family Carers UK  to its Service Users.

  1. Family Carers UK has compiled and maintains a register of Care/Support Workers who are available for work and are introduced by Family Carers UK  for this purpose
  2. Family Carers UK  uses a system of supervision and quality control for service provision
  3. Any change to your requirements must be agreed in advance between you, Family Carers UK  and the organisation that is funding your care.
  4. You are entitled to request a change of Care/Support Worker at any time.
  5. This agreement and all rights under it may be assigned or transferred by Family Carers UK  providing Family Carers UK  gives fourteen days’ notice
  6. Staff are trained to adhere to the National Care Standards Codes of Practice, a copy of which is available on request
  7. Family Carers UK  shall be entitled to vary these terms and conditions at any time
  8. All Care/Support Workers are under contract with Family Carers UK  for the provision of care services

Our personal care and support services can be funded in different ways:

Local Authority / Government Support

  • Your Local Authority or NHS Clinical Commissioning Group (CCG) may commission the care directly with us.
  • Your Local Authority may provide you with a Direct Payment or a Personal Budget to meet some of all of your care costs.

To find out if you are eligible for Local Authority support you should firstly contact your Council’s Adult Social Services team. If you quality for Local Authority support, a Social Worker will undertake a means-tested assessment and guide you through the funding methods available.

Funding your own care

  • Your family may purchase a certain number of care hours on your behalf to supplement what is funded by your Local Authority
  • It is possible to self-fund some or all of your care and you may wish to commission your own care using personal resources
  • We offer a regular invoicing and payment service with an option to pay by Direct Debit or via online payment

Points 9 to 13 apply to private or self-funding Service Users only

  1. Family Carers UK  will render an account to the Service User for services provided by the Care/Support Worker and Family Carers. All accounts are payable within seven days of the date of the invoice.
  2. In the event of any Care/Support Worker who has been introduced by Family Carers UK  entering into an agreement with the Service User or any third party to whom the Care/Support Worker was also introduced the Service User or third party shall be liable for a placement fee.
  3. Family Carers UK  will give a minimum of fourteen days’ notice of any increase in the fees payable for their services
  4. Family Carers UK  will give a minimum of forty-eight hours’ notice to withdraw the service, save in the case of substantial breach of any express or implied term by the Service User in which case the services may be withdrawn immediately
  5. The Service User shall give a minimum of twenty-four hours’ notice to terminate the service.

Request for pricing

 Our pricing of services for customers starts at a minimum of £  an hour and can increase to a maximum of £ an hour. The hourly rate for the service delivered will be calculated and vary due to the following:

  • Type of service
  • Complex nature of service
  • Time and frequency of service
  • Day(s) of the week the service is required
  • Number of Care/Support Workers required to deliver the service
  • Location of the customer to whom we deliver the service
  • We will, if requested, give a detailed breakdown of our pricing for delivery of services.

 

Data Protection

The confidentiality of your information is of paramount concern to Family Carers UK. To this end, we comply with all data protection legislation, UK Data Protection Act 2018 (DPA 2018) and the UK GDPR.

Family Carers UK ensures that the processing of Personal Data in connection with employees and Service Users complies with the UK new Data Protection Act 2018 (DPA 2018) and the UK GDPR. These policies and procedures prohibit unauthorised access to, or disclosure of Service Users’ personal information. You have the right of access to personal information held about you. The basic requirement is that the processing, both automated and manual, shall comply with the following data protection principles which require that personal data shall:

♦ Be processed fairly and lawfully.

♦ Be obtained only for specified and lawful purposes, and not be processed in any incompatible manner.

♦ Be adequate, relevant, and not excessive.

♦ Be accurate and, where necessary, kept up to date.

♦ Not be kept longer than necessary.

♦ Shall be processed in accordance with the rights of Data Subjects.

♦ Be protected by appropriate security measures.

♦ Not be transferred outside the EEA unless adequate level of data protection exists.

Any personal data you provide is used by Family Carers UK to identify appropriate Family Carers UK Care/Support Workers and services. We may also use the data to conduct market research and to keep you informed of the latest social and healthcare developments, legislative changes and Family Carers UK initiatives by mail, telephone, or email. If you do not wish to receive details of these, please tell us.

Personal data such as racial or ethnic origin, beliefs and health is for monitoring, Care/Support Worker selection and service provision purposes only. By signing these Terms of Business, you are expressly permitting us to use this information in this way.
